The Five Kages and the Neo-Akatsuki (If the ninja has a Curse Mark) are allowed to Steal ninja. You have to try and persuade the Ninja to come with you and if you can't persuade them you have the choice of fighting them and once you have them below 10 Hp you can kidnap them without them fighting back.
